Please read these Terms and Conditions carefully before sending us your order. The use of our website to purchase from us and any contracts made thereby, are conditional on your acceptance of these Terms and Conditions and our Privacy Policy. If you do not accept these Terms and Conditions, you should leave our website now.

We may update these Terms and Conditions from time to time and therefore you must check this page for any changes before making any future orders.

  1. WHO WE ARE

We operate the website www.tabithaliving.com. Tabitha Living is a small independent business operating as a sole trader.

  1. HOW TO CONTACT US

  1. OUR CONTRACT WITH YOU

A contract between you and us only comes into existence when we email you to accept your order. If we are unable to accept your order, we will inform you of this and give you the reason, and we will not charge you for the product.

  1. OUR PRODUCTS

The images of the products on our website are illustrative only. Although we have made every effort to display the colours accurately, we do not guarantee that the display of the colours on a computer accurately reflects the colour of the products. Your product may vary slightly from those images. Also, because our products are handmade and sourced from natural or recycled materials, a product may vary slightly from the information about it, such as size, weight, dimensions and measurements listed on our website. This  adds to the products individual character and beauty.

  1. PRICES

Our products are charged at the price shown on the product pages on the date you place the order. The website is regularly updated and we put every effort into making sure the website information including the product descriptions, prices and images are accurate and up to date. If, however, the product you wish to purchase is incorrectly priced, or the product has in any way changed from the way it is depicted on the website, we shall inform you when you place your order to enable you to decide whether or not to proceed with the purchase.

  1. DELIVERY OF ORDERS

Delivery costs. The costs of delivery of products you have ordered will be as displayed on our website.

When and where we will deliver your order. We aim to deliver the products you have ordered within two to three working days, and in any event within 30 days, of our receipt of payment in full for the products and delivery costs. We shall inform you when your order has been dispatched. We shall deliver to the address you have given us, but we do not accept orders for delivery to PO Box numbers, hotels and accommodation addresses. If delivery of the products to you is delayed by an event outside our control, we will inform you as soon as possible and you may then terminate the contract and we shall refund you for any products you have paid for but not received.  We shall not be otherwise liable for delay in delivery caused by such an event.

If you are not at home when the product is delivered. If no one is available to take delivery at the address you have given us, and the products cannot be posted through the letterbox, we will leave you a note informing you of how to rearrange delivery or collect the products from a local depot.

If you do not re-arrange delivery. If you do not collect the products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and we shall be entitled to charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract.

Ownership and Risk. You own a product once we have received payment for it in full. The risk for loss or damage to the product will be your responsibility from the time we deliver it to the address you gave us.

  1. WHEN AND HOW TO PAY

Please see our website for the means of payment currently accepted. Your transaction will be processed by Stripe in a secure environment. We do not accept any liability for a delay in dispatching your product if your card issuer delays your payment to us, for whatever reason. You must pay for the products before we dispatch them. If you pay by credit or debit card, the total order amount will be authorised for payment but we will only charge for the goods as they are dispatched.

  1. YOUR RIGHT TO CANCEL THE CONTRACT AND RETURN THE GOODS

We make every effort to supply products of the highest quality and hope you will be happy with your purchase. If, however, you are not completely satisfied with your purchase you have the right to return the product and obtain a refund provided that the product has not been damaged by you and is unused.  To exercise this right, you must inform us of your decision by telephone or by email within 14 days of delivery of the product to you or to someone on your behalf. You then have a further 14 days to return the product to us.

  1. DAMAGED OR FAULTY PRODUCTS

If any product is damaged or faulty so that it is not of satisfactory quality, not fit for purpose, or not as described to you by us, you have the right to return it within 30 days of delivery of the product to you or to someone on your behalf. Please ensure that you check all items on receipt, and inform us as soon as possible if you consider that the product is damaged or faulty. If your claim is justified, and the product is returned to us within the 30 day period, we shall refund the purchase price and delivery cost to you in full. If a damaged or faulty item is returned to us more than 30 days after delivery, we have the option to repair or replace it. If possible, in order to enable us to consider your claim that a product is damaged or faulty, please send us a picture of the item before returning it.

  1. RETURN OF PRODUCTS UNDER CLAUSES 8 OR 9

If you are returning any product to us, please inform us by telephone or email that you are doing so. The product should if possible be returned in its original packaging or otherwise securely packaged. Please include the Returns Slip with the goods and quote your order number. Returns must be sent to the following address, preferably by recorded delivery:

You are responsible for the safe return of the product to us which remains at your risk until we receive it, and you must pay the cost of returning it. If you are returning the product because you are exercising your right to change your mind under Clause 8, the return costs are your responsibility and will not be refunded. If you are returning a product because you consider it to be damaged or faulty, and our inspection of the returned product confirms that it is damaged or faulty, we shall refund the cost of returning it, but we will only be liable to refund you the approximate first class postage cost.

If you are entitled to receive a refund or replacement for a returned product, we shall endeavour to process the refund or send the replacement within 21 days of receiving the returned item.

  1. OUR RIGHTS

We are entitled to terminate the contract with you and will be released from our obligation to deliver the products, if, despite our reasonable efforts, we are unable to contact you or arrange delivery or collection of the product; or if you have not paid any sums which are due to us.

We are not obliged to accept the return of any products which have been used or damaged by you.

Our products are only supplied for private and domestic use and not for any commercial or business purposes or for re-sale, and we will have no liability to you for any consequential losses such as loss of profit, loss of business, business interruption, or loss of business opportunity.
